Understanding the legal landscape of hemp CBD
Although the history of hemp’s use stretches over centuries since the FDA does not yet regulate non-prescription CBD products, misguided claims about the plant and products made from it run rampant in the marketplace. This uncertainty can carry over to the legality of CBD products when it comes to CBD for animals.
Consumers want to know: what CBD can you trust? What is legal? And what is best for my pet? ElleVet Sciences is dedicated to answering these questions and providing insights into the legal and regulatory status of CBD and hemp products for pets in the animal health industry.
CBD & Pets: The Farm Bill Effect
When the topic comes up of CBD and pets, one of the first questions is usually: is it legal in my state? Since hemp and marijuana are often inaccurately grouped together, the laws and how they are applied can be difficult to navigate for pet-owners. According to the 2018 Farm Bill, hemp-derived CBD products with less than .3% of THC are legal to produce and sell. If your CBD comes from hemp and contains less than 0.3% THC, it is legal under federal law.
THC Levels in Hemp CBD
Minimal amounts of THC (Tetrahydrocannabinol) are beneficial in hemp-derived products as it makes the CBD cannabinoid more effective, working together through the entourage effect to provide maximum relief to your endocannabinoid system. THC and CBD (Cannabidiol) are just two of the hundreds of cannabinoids found in cannabis. While beneficial, THC is toxic to dogs in levels exceeding 0.3%. Trace levels of THC below 0.3% will not make your dog sick or high, only complement the CBD you use for your animal.
While Hemp-Derived CBD for Animals is Federally Legal, Marijuana-Derived CBD is Not
This is where a lot of consumers get confused. Marijuana is still listed as a Schedule 1 controlled substance according to the US Drug Enforcement Agency. Unless you live in a state where marijuana is legal, CBD extracted from marijuana is prohibited.
Besides Legality, What Are The Differences Between Hemp and Marijuana?
While CBD can be found in the marijuana plant, it is far more abundant in the hemp plant. Hemp, while closely related to marijuana and part of the same species (Cannabis Sativa), is not the same plant.
What is Legal in My State?
If you are curious about more in-depth hemp laws specific to your state, we would recommend contacting your state’s lawmakers to discuss CBD and pets. A majority of states have hemp farming programs already in place with established guidelines for hemp manufacturing and sale.
